Navigating the Legal Landscape of AI Generated Administrative Decisions in the EU
Public authorities across Europe increasingly rely on AI to prepare and issue administrative decisions – but what does the law actually require of them?
This intensive summer course, offered annually during the first two weeks of August, equips students with a foundational understanding of how EU legislation and core administrative law principles regulate AI-generated governmental decision-making.
The course examines how different administrative sectors implement AI-driven decision-making at varying levels of automation, and surveys the key EU regulations governing the lawful development and operation of these systems.
Central questions include how AI-generated decisions align with fundamental principles of administrative law, such as transparency, the duty to give reasons, and access to information, as well as issues of legality, competence, delegation, and judicial review.
Drawing on case studies from several EU countries, the course takes an interdisciplinary approach, incorporating perspectives from sociology and data science to explore both the technical dimensions of these decision systems and how they are used in practice by caseworkers.
Teaching combines lectures with extensive collaborative classroom discussion, and the course concludes with a 20-minute oral exam.
